What is the law relating to clamping?

It is a criminal offence to clamp a vehicle on private land unless this is done by a lawful authority such as the police, DVLA and local authorities.

Privately owned land includes car parks, such as those at retail parks, whether or not there a fee is payable in order to park there.

Clamping a vehicle on a public highway is also a criminal offence and can only be done by public bodies such as local authority, the police or the DVLA. In this instance vehicles are usually clamped if the vehicle has no excise licence, parked in a no waiting area or other restricted area (eg permit holders only).
